General Terms and Conditions

Scope of Application

These General Terms and Conditions (hereinafter referred to as "GTC") of Bobby Lau, trading as "Pandakuni" (hereinafter referred to as "Seller"), apply to all contracts for the delivery of goods that a consumer or entrepreneur (hereinafter "Customer") concludes with the Seller with regard to the goods presented in the Seller's online shop. This excludes the inclusion of the Customer's own terms and conditions, unless otherwise agreed.

Consumer

For the purposes of these GTC, a consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed.

Entrepreneur

For the purposes of these GTC, an entrepreneur is a natural or legal person or a legal entity under public law that, when concluding a legal transaction, acts in the exercise of its commercial or self-employed professional activity.

Contract Conclusion

The product descriptions contained in the Seller's online shop do not constitute binding offers on the part of the Seller, but are intended to be used to submit a binding offer by the Customer.

The Customer can submit the offer via the online order form integrated in the Seller's online shop. When the Customer has placed the selected goods in the virtual shopping cart and has completed the electronic ordering process, the Customer submits a legally binding binding offer for the goods contained in the shopping cart by clicking the button that completes the ordering process.

The Seller can accept the Customer's offer within five days:

  • by sending the Customer a written order confirmation or an order confirmation in text form (fax or e-mail), whereby in this respect the receipt of the order confirmation by the Customer is decisive;
    • by delivering the ordered goods to the Customer, whereby in this respect the receipt of the goods by the Customer is decisive;
    • by asking the Customer to pay after placing the order.

      If several of the aforementioned alternatives are present, the contract is concluded at the time at which one of the aforementioned alternatives first occurs. The period for accepting the offer begins on the day following the sending of the offer by the Customer and ends with the expiry of the fifth day, which follows the sending of the offer. If the Seller does not accept the Customer's offer within the aforementioned period, this is deemed a rejection of the offer with the consequence that the Customer is no longer bound by his declaration of intent.

      If the Customer chooses one of the payment methods offered by PayPal, the payment processing is carried out via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter referred to as "PayPal"), under the terms of the PayPal Terms of Use, which can be viewed at https://www.paypal.com/de/webapps/mpp/ua/useragreement-full or - if the Customer does not have a PayPal account - under the terms of the conditions for payments without a PayPal account, which can be viewed at https://www.paypal.com/de/webapps/mpp/ua/privacywax-full. If the Customer pays using one of the payment methods offered in the online ordering process, the Seller already declares the acceptance of the Customer's offer at the time the Customer clicks the button that completes the ordering process.

      Conclusion of the Contract via the Online Ordering Form

      After the Customer has placed the selected goods in the virtual shopping cart and has completed the electronic ordering process, the following data will be stored by the Seller:

      • the Customer's title, first name, surname,
        • the Customer's address,
          • the Customer's e-mail address,
            • the Customer's telephone number.

              The Customer can view and change the data stored about him at any time by logging into his customer account.

              Language of the Contract

              The language of the contract can be either German or English.

              Order Processing and Contact

              Order processing and contact usually take place by e-mail and automated order processing. The Customer must ensure that the e-mail address he provides for order processing is correct, so that the e-mails sent by the Seller can be received at this address. In particular, the Customer must ensure that spam filters are configured so that all e-mails sent by the Seller or by third parties commissioned by the Seller to process orders can be delivered.

              Right of Withdrawal

              Consumers have a statutory right of withdrawal.

              Prices and Payment Conditions

              Unless otherwise stated in the product description of the Seller, the prices indicated are total prices including value added tax. Any additional delivery and shipping costs are specified separately in the respective product description.
